1. Introduction

These Terms of Service ("Terms") are entered into between you ("Customer", "you") and Green Marvel (Pty) Ltd (Registration No. 2023/866045/07), trading as Marvelously Green ("we", "us", "our"), with its principal place of business at House No 10135 Letlhabile Section, Mantserre, Rustenburg, 0339, South Africa.

By accessing or using our website at greenmarvel.co.za, registering an account, or placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

2. Definitions

• "Products" refers to the organic hair care products sold on our website.
• "Order" means any request to purchase Products from our website.
• "Account" means the customer account you create on our website.
• "CPA" refers to the Consumer Protection Act 68 of 2008.
• "POPIA" refers to the Protection of Personal Information Act 4 of 2013.

3. Your Account

You may browse our website without creating an account, but you must create an account to place an order. By creating an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and update your information to keep it accurate.
• Keep your password confidential and secure.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

You must be at least 18 years old, or have the consent of a parent or guardian, to create an account or place an order.

4. Orders & Payment

All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order at our discretion.

4.1 Pricing

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices may change at any time without notice, but changes will not affect orders already confirmed.

4.2 Payment

We accept payment through Payfast, which supports credit cards, debit cards, EFT, and other South African payment methods. Payment is processed securely and we do not store your card details on our servers.

Your order is only confirmed once Payfast notifies us of successful payment. Until then, your order is in "pending payment" status.

4.3 Order Confirmation

You will receive an SMS notification once your payment is confirmed. You can also view your order status by logging into your account.

5. Shipping & Delivery

We currently ship within South Africa using The Courier Guy. Shipping rates are calculated at checkout based on your delivery address and package weight.

5.1 Delivery Times

Standard delivery takes 2–5 business days from dispatch. Dispatch typically occurs within 24 hours of payment confirmation, excluding weekends and public holidays.

5.2 Delivery Address

You are responsible for providing an accurate delivery address. We are not liable for delays or non-delivery caused by incorrect address information.

5.3 Risk and Ownership

Risk in the Products passes to you upon delivery to the delivery address specified in your order. Ownership transfers once we receive full payment.

6. Returns & Refunds

Under the Consumer Protection Act (CPA), you have specific rights regarding returns and refunds:

6.1 Cooling-Off Period

For online purchases, you have a 7-day cooling-off period from receipt of goods to cancel your order and return Products for a full refund, provided the Products are unopened, unused, and in original packaging.

6.2 Defective Products

If a Product is defective, you may return it within 6 months of purchase for a repair, replacement, or refund at your choice, in accordance with the CPA.

6.3 Return Process

To initiate a return, contact us at [email protected] with your order number and reason for return. We will provide return instructions and a return address.

6.4 Refund Processing

Approved refunds will be processed within 7 business days of receiving the returned Products. Refunds are issued to the original payment method.

7. Product Information

We strive to display Product information, including ingredients, benefits, and usage instructions, as accurately as possible. However:

• Product images are for illustrative purposes and may vary slightly from actual Products.
• Results from using our Products may vary depending on individual hair type, condition, and usage.
• Our Products are cosmetic in nature and not intended to diagnose, treat, cure, or prevent any disease.
• Always perform a patch test before first use to check for any adverse reactions.
• Discontinue use and consult a healthcare professional if irritation occurs.

8. User Conduct

You agree not to:

• Use the website for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the website or our systems.
• Use automated tools (bots, scrapers) to access or interact with the website without permission.
• Post or transmit any content that is defamatory, offensive, or infringes the rights of others.
• Use the website in any way that could damage, disable, or impair its functioning.

9. Limitation of Liability

To the maximum extent permitted by law, Green Marvel (Pty) Ltd shall not be liable for:

• Indirect, incidental, or consequential damages arising from your use of our Products or website.
• Any loss of profits, revenue, data, or business opportunity.
• Adverse reactions or skin sensitivities that occur despite following usage instructions.
• Delays or failures caused by events beyond our reasonable control (force majeure).

Nothing in these Terms limits any rights you have under the Consumer Protection Act or other applicable South African law.

All content on greenmarvel.co.za — including text, images, logos, product names, formulations, and design — is the property of Green Marvel (Pty) Ltd and protected by South African and international copyright and trademark laws.
